An Employer cannot implement a policy, not make the employee aware of such policy exists, and then discipline them for breaking such policy. The employee knowing the company has a policy manual, does not excuse the employer from explaining the policy to the employee when implementing it.

Employers in the U.S. typically require employees to sign acknowledgments that they are aware of and have read policies to eliminate ambiguity over whether an employee is aware of / understands a policy or not.
