Yeah I suppose they are liable if there are problems but moderate chance that damage happens to the xDrive system. I don't know specifics of how it works but for a mechanical diff AWD system rule of thumb is you should not exceed 1% difference in diameters front to rear. With modern more electronic systems I think you can get away with 2%, but most people don't push it with anything more than that. Do report if there are more problems but I hope you're in the clear. 245/265 would make a great setup.
