I always put K&N filters on my cars and never had any issues whatsoever. Every aftermarket induction kit or panel filter works with oil and it is an extremely common mod to make.
As for performance gains, this alone does close to nothing but together with a sports cat or a cat less DP it allows for big gains to be made with a remap/piggyback chip tune.

I bought the BMW Performance intake for my E90 330i and it came with a KN filter. So if the factory ships them with their own aftermarket intakes I wouldn't worry about any issues.
