Not really mad. Surprised and annoyed since I wasted my time taking my new car back to the shop and having them accept it (with same photos - so they knew exactly what was going on), coordinate a loaner, etc. for something that if I had been informed about there would have been consistent expectations.

Agree with Mark above that there is adequate technology to keep this precise, accurate and compliant regardless of vehicle factors or location. There is also no law or Federal legislation that mandates >5% off. BMWUSA's excuse didn't account for the extreme approach and wasn't consistent with the fact that as tires wear, your speedo will over-report your speed more. My theory is that they are taking a heavy hand to have consumers drive slower and have less/less costly accidents. Admirable but doubtful altruistic. It is more likely based upon helping achieve some statistic somewhere that BMWs are safer vehicles.
