I’ve practiced law for 20+ years - the common law and general view of spoliation only applies to the intentional destruction of evidence which is ALREADY in existence. It DOES NOT apply to evidence you fail to gather or preserve nor does it apply to evidence destroyed unintentionally.
Interpretation and applicability vary among jurisdictions but this is the general view.
