***F*CKIN PIST*** Car hit in parkin lot of dealership...
I stopped by my service department today to speak to my buddy, who is a tech, and speak with my SA about these "ECU reprogram rumors." Somebody back into my passenger side front door... F*CKIN PISSED... Nobody saw anything and of corse they took off. The service manager called the police and we reported it. When I got done speaking with the Office (real nice guy), i went back in to ask the service manager how they would like to handle the situation. Being the car got hit on there property, and the person took off, unfortunatley I need to hold them responsible. He kinda looked at me with a shocked, dumb look on his face, and stated the their insurance company will be contacting me...
As for the damage: there is about a dent the size of a quarter in my door, from maybe a license plate screw or something on a bumper. i buffed most of door clean. I contacted my insurance, just so they are aware of what's going on. I also emailed BMW, incase the dealer decides not to do anything. Any other suggestions??? |

that's terrible. sorry to hear.
however, it's beyond me why you would think the dealership is responsible for this?

I kind of agree... This happened to me a few years back in a grocery store parking lot, neither the cop or my insurance company suggested the grocery store would be responsible.

I could be wrong but I dont believe the dealer has any responsibility in this case. I think they could only be held responsible if one of their employees did the damage. They may choose to go ahead and help you out in kindness and to make you happy if they feel you are a good possible repeat customer, but I doubt it. Did it chip or scratch the paint any? If not, have a dent repair specialist look at it. They could do it fairly cheap without repainting.

because it was on their property in a way over-conjested parking lot, in which most of the cars are "double-parked" and i believe it may have been an employee (what i was told).

If their lot was as crammed as you say it was, which many that have small lots are. You might have a chance. GL

Then you'd have every reason to be Good luck though, keep us posted, I'm interested in what the dealership decides to do. If it's a ding that didn't scratch or chip the paint they can get it fixed for less than $30 most likely.

Sorry to hear about your situation. But unless one of their employees did it and you can prove it, good luck. If Joe Customer did it, what duty of care did the dealer breach? That's what you'd have to prove in court.
You'd be better off either repairing it yourself (which is what I would've done without calling my insurance carrier) or, if there's enough damage, paying your deductible and letting your carrier determine if subrogation is possible/worthwhile. |

I feel for you. I'd make the dealership ask everyone there who was coming and going at the time. They'll know when their employees were at. They'll probably be less apt to help if they think it's another customer. I bumped someone's trunk a few months ago in a Jeep, went in, fessed up, and the insurance company took care of it. I got a freebie because I had a perfect record. Whoever did that to your car is a coward. I hope they don't sleep for a year. Find the fu__er.

agree with mfstout, find the fu__er and get him/her to pay for it. I've seen a lot of people do that on campus (girls who drive huge SUVs and scratch other cars when parking)

I hate people who damage others property and run like a little chicken shit and leave the repairs for the owner of the property. Nothing pisses me off more than disrespect for others property. To the OP, I know it sucks, it may end up costing you a little money but your car will be made as good as new again.

Sorry to hear about the damage, of all places, it has to happen at an authorized BMW dealership...
Anyway, I must have gotten something out of my education. I beg to differ, if it were an employee, then it would definitely not be the dealership's responsibility. We get into an area pretty well visited by case law. If an employee hit a customer's car, and fled the scene, that employee did something willful. It's clearly against the policy of the dealership for employees to engage in criminal activity. The SA did a very wise thing in reporting the incident to the police. He assisted his insurance co. in washing their hands of the incident. Or at minimum, they got a good jump on establishing that something criminal, as opposed to civil, took place. If, on the other hand, a tech took the OP's car to the convenience store at lunch and scraped the side of the car, and told the SA, then it was negligence, in which the dealership's insurance would take responsibility. In the end, the OP is covered, but imho, by his own comp which covers hit and run. There should be no surcharge nor increase to his policy since it's hit and run. |
