Can BMW deny my CPO warranty saying that I failed to apply to the updates?
No you won’t lose the warranty, although taking it in for service they may update your software so be careful.

I have a 24 LCI and I would do anything to get rid of the ASS.

I’m likely to update a 21 X5 M50i to a 24/25 X7 M60i. I’ve had ASS disabled via Bimmercode for 4 years now.

Does the M60i at least have a hard button to disable ASS from day one until I use Bimmercode to get rid of the most annoying “feature” ever put into a car permanently?

There is no button unfortunately. BMW is being mandated by the EPA among other regulatory agencies to implement this “feature” with no way to turn it off.

The only workaround is sport mode. You can configure sport mode with everything set to comfort except turn DSC off and ASS will be disabled. It sucks but that’s the best workaround.
