That will probably be about 2k damage according to cops who fill out reports.

Then the insurance customer has a fit when their insurance carrier pays for the damage at 41k.

Moral of this scenario. Cops know some laws but not body work for vehicle damages

I agree the pickup truck owner is guilty of nothing more than illegal parking. Where I live, the local government plants bushes and erects other visual obstructions in the median and on corners at intersections. It's up to drivers to exercise extreme caution. Maybe they do this on purpose so drivers actually stop for red lights and signs.

Sucks this happened to you. I was involved in an accident a few months ago, was rear ended, and just got my X7 back last month after a month sitting in the shop being repaired. Since the at fault driver got a citation his insurance took full responsibility.
X7 was only 3 months old. Took one month to order initial parts such as bumper cover and tailgate, then another month in the shop for repairs and paint. Looks good as new now.

In your case it’s hard to say what the insurance companies will do. Did the caravan driver get a citation? If not, then may be hard to put any fault on him. The F150 driver, well, he’s gone and didn’t really do anything except illegally park, so putting any blame on him for the accident may be difficult.

I wouldn’t want this on my insurance record given the amount of damage, so you may have to take it to court or something to determine fault.

Insurance company of the caravan may even say it was your fault. Caravan had the right of way and you were entering the intersection. I know you said the caravan was speeding, but if they didn’t get a citation driver could say he wasn’t speeding.

Well, glad you are your family are safe. The X7 can be repaired. Hope you get this all worked out.

Very often, we are given opportunities to show our character. Perhaps an anonymous forum may not be the best platform to demonstrate this. I chose instead to emphasize w/ BigEvan1923's situation, putting myself in his shoes. How often have we been put into an "impossible" situation where the result is you screaming at the sky, "F*ck my life"?

Yes, the pickup is not liable for any of the damage resulting from the accident. It doesn't make the situation any less frustrating!

all good, im just frustrated with the situation - I take responsibility for my presence at the scene, it just hurts that cautious driving and normal behavior still netted a nasty outcome.

The saga is over. Fortunately I was found not at fault and the body shop (one of two bmw certified repair shops on Long Island) did an incredible job. If you’ve ever got work to do Bradan coachworks is fantastic and they OEM-spec verify all the work/calibration with Habberstad.

no fault insurance is misunderstood...
So let’s start with a basic definition: no-fault insurance, sometimes referred to as personal injury protection insurance (PIP), can help cover you and your passengers’ medical expenses and loss of income in the event of a covered accident, regardless of who is found at fault.
believe me, insurance absolutely determines and assigns fault, even in NY.

Yep! I was just about to reply with this. At first they just assumed I was at fault given the nature of the accident, then I sent the drive recorder footage from the car and was found not at fault. The hit to my premium would have been insane!

Not sure on a lease or if you can even do it on a lease since you don’t own the vehicle. When I did mine I had to provide a copy of the title to the insurance company.

You start the process by notifying the at-fault insurance company that you want to file a diminished value claim. For me, they just requested a bunch of documents like title, repair bills, service history. Then they came up with a value to offer me. It was negotiable of course, so I countered and we eventually came to a number that worked for me.
