cold or hot does not make any difference with brake fluid. Also, the max mark is for new pads. As the pads wear, the level drops which is normal. You should avoid topping off as pads wear. If you top off, then fluid must be removed when pads are replaced.

My pads are not new. I did brake fluid flush therefore the top off. If I understand this correctly, I can leave it as it is and remove some fluid when going for new pads?

correct. take out the excess with a turkey baster or some other method when you change the brake pads next.

otherwise when you push the pistons back into the calipers it will force fluid back up to the master cylinder and overflow.

just as a warning to you, brake fluid will eat right through paint, so be very careful!!!! and if you do spill some on your paint whatever you do DON'T wipe it off! spray it off with water.
