Just moved to Dallas and wonder if I can do the catless/high flow headers assuming tuning codes out the check engine. Sounds like they only check the OBD port for faults. Please let me know if anyone have any experience... I will post local too but you guys knows it all so gave it a shot here first.

They are required to do a visual check, but not all places do. As long as you don't have a check engine light on and not more than one monitor set to "not ready" you'll pass the emissions test. I had no cats on my old Subaru, but passed because they rarely looked under the car for the cat. I also used to be a state inspector.

Edit: Unfortunately you won't pass without cats. Unless they make a fix for the 328 like they do for the N54 335s.

It doesn't matter what you have as long as you have a cat to pass the visual test, and everything checks out on the OBD scan. My subaru was catless and had a open-source tune (with the cat codes "deleted") and I never had a problem passing inspection in the 6 years I had the car. I did have a gutted cat in my garage in case any of them ever looked under the car, but they never did.
