Takata Lawsuit - Supporting Documents
So I, like many others here, got letters to sign up and check for my VIN or be included in this lawsuit for up to $500.
I did so and now I have a letter of objection saying I should be excluded for lack of supporting documents. Any ideas what "supporting documents" for proof of claim I should be uploading, is this simply a redacted copy of my registration? etc Last edited by kens; 07-20-2019 at 02:52 AM.. |

Can I just ask something? Why?
I get it. The company messed up. They got themselves into a mess. But why pursue $500 from a company that is broke because of this? Isn't it enough to get a new airbag and move on? The only people that benefit from this are the lawyers behind this. Why spend time trying to chase down $500? |

They probably want expenses, like the cash outlay from hospital bills due to faulty inflators, or money you spend out of pocket on a rental car after your car could not be repaired due to insufficient stock etc.
When I read through the legalese, it sounded like it was a class action suit for damages, not on preventative replacement. BMW was proactive, having no actual failed devices. I didn't feel I incurred enough to pursue any claims. "I'm suing you in this class action, because your crappy product did nothing, and was replaced at no cost to myself" That being said, I'm not a lawyer, and this could just be a bluff to get 50% of the claims dropped. I got the letter and did the math. Based on the number of potential claimants and the max settlement amount less the lawyers take, I figured the average payout check was going to be around $30.

A manual transmission can be set to "comfort", "sport", and "track" modes simply by the technique and speed at which you shift it; it doesn't need "modes", modes are for manumatics that try to behave like a real 3-pedal manual transmission. If you can money-shift it, it's a manual transmission. "Yeah, but NO ONE puts an automatic trans shift knob on a manual transmission."

I thought this class action lawsuit was against BMW, hence why I opted out. Takata messed up, not BMW.
