Sure they could. Just add laws that crack down hard on private growers with real jail time and/or very hefty fines and taxation on profits. The IRS will have no problems grabbing at more money

They could do that, but then they'd have to budget a new department to monitor the traffic of marijuana. It's not just private growers, it's the importing too. TBH, I think the US would probably legalize cocaine if it had direct control of its growth, distribution, and sales. It's all about money. Democracy is still capitalism at heart.
