i've read mixed comments on this....would they even care because its not engine warranty work...

I just took my 135i for a new HPFP and didn't take my cp-e cat-back off and haven't gotten any comments from the dealership as of yet. I should have the car back today or tomorrow and will keep you posted.

I spoke directly to the owner of my dealership (a big chicago one) and he said that it was ok to have catback. They really worry about things like intake and engine tune, so you should be ok

Zero reason to take it off.
If all the cats are in place, you are legal.
And a catback exhaust does not increase boost or do anything to increase ENGINE power, just lets it breathe better (which is where the slight power increase comes from) and if anything it's easier on the engine.

FWIW I recently took my car in w/a tune for new rear brakes + fluid flush and the dealer didn't mind/care/mention it so you should be fine w/just the catback.

Got my car back on Thurday of next week after having the HPFP replaced and there were no issues with having the exhaust on there... in fact the service guy commented on how good it sounds.

Everything depends on the dealership. I took my 07 335i coupe in for the one year oil change and state inspection.I have a BMS intake and SSTT and left them in.I asked my salesman about the dealers mod policy,and he told me not to worry and leave everything on including the TT as all the techs are into modding.He said if there was a problem that involved something like the ecu or similiar to take out the TT,but i could leave the intake on.He even went in and spoke with the tech that was doing my car about the mods.When done i was talking with three of the techs about how i like the SSTT over the JB tuners that they have on there own cars,etc.

I talked to my SA about my cat back exhaust and he said its no problem at all, as long as it truly is secondary cat back.
