Advice needed prior to picking up car from 6 weeks of service...
to make my story short, my car has been in service for 6 straight weeks, and as of today, the SA told me it's all fixed and ready for pickup.
a little summary; my car was updated to the laggy software 30.2 and fuel pump changed sometime back in July, and has caused a lot of problems afterwards. dvd drive not reading the disc, rattle from the wastegates, the accelerator pedal/component causing a limp mode (pretty bad i nearly got hit by a truck once because my car lost half the power and it wouldn't accel right away). the car was brought back to them a week later, they replaced the dvd drive, fixed the accelerator pedal problem, and gave me new wastegates, but the rattle was still there. i called my SA up and told him the rattle is still there, then scheduled a loaner appointment which is a month later. on 10/20/08, that's when i dropped off my car for the rattle fix. a couple of weeks ago i was asking my SA to help me with the buyback/trade assist thing, cuz i really wanna get out of this car. he said he'll try to help me out, but i felt that he was just trying to buy more time to fix the car. till date, the car was in the shop for a total of 8 weeks for one problem. today, my SA called me and said my car is all fixed. he told me to pick it up and drive it for a week and see if the problem still exist. now my question is, should i go pick it up? i'm afraid if i pick it up, i will lose my option of having the dealership do the buyback/trade assist. the last thing i would wanna do is get a lawyer involved. so anyone could pls chime in with your suggestions and experiences? btw, i am located in NYC. my car is an 09/06' built with 29k miles. Can they buy back a car that is 2 years old? I would call BMW NA though and go through them to figure out your options, rather than going through the dealer.

I would pick it up and drive it. If the problem is still there you have more more then a leg to stand on. It will be hard to get them to buy it back at this point.

Are there any "lemon laws" in your state? Ok, I just checked google, and there is a lot of information that comes up under "new york lemon law". I'd research that information, you may be able to use the lemon law to get out of your current vehicle and into a new car with minimal cost.

At that age, it doesn't seem to qualify for trade assist/buyback either, since BMW uses that to avoid getting into a lemon law situation.

I just had my Z4 bought back and picked a new E92!
And I'm in NJ. Man your car is having hell of a problem, but your car is too old to be considered as lemon or trade in assist or what not. But i'll still call up a lemon law laywer (just google 'lemon law NY') and ask what they could do. They will usually call back within 30 min and let you know if you car is eligible or not. If your car qualify, perfect, but if not move on to other option. Call, BMW NA and ask them to transfer you to the appropriate person to discuss about lemon law situation. You might not get a representitive 'for' you right away but keep on calling to get a right person and once you feel like you got a right person, get their info and ask them to help you out. It's bit of dragging process but worth a try. It took me about 2 months to get everything sorted but totally worth it. Good luck. |

i've called bmw na yesterday, and they said they'll get in touch with the dealership, but probably won't get back to me anytime soon. the dealership is forcing me to pickup my car, otherwise i'll have to pay $40/day for the loaner car. guess i'll have to pick up the car first and then pursue on with bmw na.
