You location states ur in NY...so both of you have NY state license?
If so, you both have nothing to worry about. NY will not take out of state points.

Even if your from NJ, you will not be effected by the summons. The operator of the vehicle (your friend) is responsible for it.
Anyway... if he's concerned about the points, tell him to plead not guilty, go to court, and see if they will change it to Unsafe Operation on a Motor Vehicle. (39:4-97.2) Its a no-point summons, but carries a higher fine. 39:4-97 (careless driving): Usually around $100 fine + 2 points. 39:4-97.2 (unsafe operation): $150 fine, $250 sur-charge from the state, plus court fees. Ballpark total: $400-$440 Only catch is that you can only use the unsafe 3 times within 5 years. 1st time - no points, high fines 2nd time - still no points, but an even higher fine 3rd time - 4 points, high fines You'd have to do the math after finding out how much your insurance would go up, and for how long. |
