Take it to a BMW Collision Center and contact your insurance..sounds like you have serious front end suspension damage..and your car is very new..so dont cheap out on where you take it

Any time you rear end a car its your fault...unless you can demonstrate you were cut off..its gonna come down to the police report

Absoluetly..BMW collision center work with every major insurance company..the only question is if you r are going to get paid by the other guys insurance or if you going to have to file a collision claim w urs..step 1..is contact your insurance company immediately and tell em what happened that he cut you off and so on..step 2 get the police report..

Either way you are covered it would just suck if you have to make a claim thru ur insurance if this guy cut u off

So sorry. It's pretty clear you're not at fault. I'm a little worried about your alignment, suspension, and how it will drive at high speed after it gets fixed. It would be a shame for it to pull to one side... these things get magnified at high speed.

from the looks of the pictures its not your fault and looks more like the person came into your lane. ive been in a collision like yours before but i actually hit the person in the rear corner and the officer said it was the other persons fault due to improper lane change. first step is to call your insurance company and explain what happened. if you need some answers and or concerned about anything dont hesitate to ask your insurance, they will take care of you. hopefully your ok and good luck with everything.

Of course the OP was at fault - and he knows it. Perhaps that is one reason why he didn't tell us the whole story.

Not to rehash investigative techniques but the OP's "story" is missing lots of pronouns at the beginning. That is a clear indication of deception.

Why would you drive a car thats been damaged, especially the steering and wheel?

You have insurance, call them, call the other guys insurance, and wait for the adjusters, and have it repaired. Dont take a check, there may be hidden damage in suspension area, it will require both body work and BMW service to repair it.

regardless of fault, if you were speeding and the other car came into your lane, its your fault, as you should have full control of your car at all times.

WTF are you talking about - look at the evidence in the pictures, it looks like the other car went into his lane, how is that his fault?

35mph and flying up 3ft in the air don't match.

I have no clue what happened but I know what did not happen.

From the pictures and the story it sounds like it's not your fault. I'm not sure as to how your car would go 3 feet in the air.

As others have said take it to a BMW collision center. I made the mistake of taking my car to another shop after I hit a deer last November. The shop did excellent work, but they did not have the correct equipment to reprogram the computer. I had to take the car in 3 times for the adaptive headlights not working, drivers side headlight flickering, and drivers side door not opening. This was a major pain in the rear, in the end they took the car over to the BMW dealership to reprogram the car and fix the issues. A week and a half job took a little over a month.

The insureance company's will probably come up with some split of who is at fault even though it looks like it was not the OP's fault from the pictures. Looks like he was in the persons blind spot. Also not so sure he was going "35" though. Sounds like some aggresive driving may have been at play... Passing on the right maybe??

either that or he was on the phone and didnt see the car coming in his lane, afterall, why didnt he use the shoulder, if all cars are going the same mph???

If you have a "15-minute" insurance, DO NOT go with their Express repair service - this is a mass production shop with NO attention to details. Insist on a BMW repair facility.

Most likely, the edge of one wheel rolled up over the other wheel. You can see that the impact pushed the body panels in on both cars, exposing the wheels of each. If you look at the rear quarter panel on the silver car, you can see rubber over the top of the rear wheel. You can actually see where his wheel rode up her quarter panel. This would put the front of his car a couple feet in the air.

If you've ever watched any type of open wheel racing, you know what I'm talking about.
