My dealer can't fix my car... need advise please

In less than 2 months of E92 ownership, my adaptive headlight stopped working. I bring it in for a service thinking it should be a quick fix.
My car has been in the shop since 06/05/07. The service rep. says they installed new headlights and they are having trouble re-programming the car. He said they contacted various resources but still can't figure out why the car is rejecting the new program.

I do have a loaner... E90 328xi (AT). I guess it could have been worse but I am running out of patience. I waited 3 months for my E92 (MT) and now in less than 2 months, I don't have my car... The service guy can't even tell me when I will get my car back at this point.

Should I call BMW NA to complain about this issue? Anything I can do at this point besides waiting and waiting...? The worst part is that they can’t even give me any timelines as to when I will get it back. I feel like I’m kept in the dark.

Any advise would be appreciated.

have you ever heard of the lemon law.... works wonders in NJ.... its not your problem that they cant fix the car....why should u have to ride around in a loaner.... get it lemoed and get a new car... oh yeh and make sure you get back the moeney you paid for it while in service

i hope you can get your car lemoned. but it is actually not that easy. if you want you have to go to court and go to the processs.
I don't think that the dealer will be scared of only after a week. wait a while and if they still can't fix it, tell them that you want a new car or you will lemon it.

Not even close to lemoning yet, it has to be in the shop 3 times for the same problem or for 30 days within the first year to be eligible.

oh snap- I thought he said it's been there for 2 months.

Anyhoo, if the dealer cant fix it they will call BMW to send a tech/engineer to diagnose the problem. If they still cant fix it I suppose they will have to replace your car??

The lemon law process is actually easier than you think, no court is necessary or anything like that...trust me

Oh no! Very sorry to hear of your troubles Bling. Here is some optimistic advise:

1. Ask the dealer if they have escalated the issue to BMW or opened a PUMA case. If so, ask them what you should expect in terms of waiting for the repairs to be complete.
If the answer is no, ask why - and insist they escalate the issue and get engineers involved. Don't let them "learn" on your car so that it will be faster for the next one.

2. Assuming that you feel they are doing what they can, try to be patient and let them keep their word. You might also speak to the general manager of the dealership and express that you understand things like this can happen, but you feel you should be well informed of the status and the expected length of time you have to wait.

Try that approach first. The responses and answers you get will give you an idea where to go from there.

Hope you get your baby back soon!!

Lemon law is used in cases of extreme neglect and defective products. You will NOT get a new car, Save money, get over on the dealer or anything like that. You will get a depreciated value on your current transportation after spending many hours and many dollars in arbitration. It will almost universally cost you more than it's worth.

People that promote litigation have not been involved in it. It's one of life's most unpleasant experiences, try to avoid it.

+1 A week? There are some poor bastards that have been waiting on fuel pumps on their 335s for MONTHS...You have an almost identical loaner car--don't sweat it, I'm sure you will get your car back soon....

+1 a week is a little weak to start talking about lemon. However each state is different in Lemon laws so if it goes another 3 weeks you could look into it. I'd talk to the dealer or the manager first and see what answers you can get.

My mistake....I redact my prior post--RAISE HELL!!!! This is a travesty!!!!

BTW--I do agree with bling that a headlight should not be that big of a deal--you would think that they could get everything done and all the programming to work within a week. I was just busting his balls a little b/c at least he's in a Bimmer--we all know too well some of the other stuff people drive when their car is in for service.
