Poll: Should have I been told
Im taking a poll:
As some of you know, I was sold (unknown to me) the 335 E93 that was used as the display car at the autoshow in toronto. The car was open for the public to go in and out of, and the roof was demonstrated occassionally. Since I took the car the following have gone wrong: 1. BMW assist was not working when delivered 2. Ashtray in front console had no power going to it 3. Leak in roof (fixed) 4. Leak in roof (fixed) 5. I recently noticed there are no cup holders in the rear console (is this a preproduction vehicle?) 6. The roof had a significant click apparent when the roof was being stowed that was fixed 7. The key fobs for the vehicle were programmed for Imperical, wher we use the metric here in Canada, and the OBC reverted to Imprerial spontaneously after programmed Is this a preproduction vehicle (no cup holders) December 06 production/sold to me in May 07? Please reply to my poll, without too much flaming

I dont see a poll. But yes, I think it should have been disclosed that it was a "Demo" vehicle.
EDIT: I see your poll now. My question for you though is, if you had known it was a Demo, would you have taken a discount on it if they offered? I honestly dont think so, so it shouldnt be an option.

so you're saying that the dealership did NOT tell you that it was a demo when selling you the car?

there was 100km on the car, it was a "display" car, not a "demo", according to the "law"
they presented the car as "new"

Does that mean that cars sitting on the showroom floor that everyone walks by, gets in, opens and closes on a daily basis, are "display" cars?

HyperM3: apparently yes. They say it is no different than the car sitting in the showroom.

Thats kinda hard to argue then. However, I still would have liked to have it disclosed that it was a "Display" vehicle at an autoshow. That would give me the creeps. All those kids with grimey hands touching and poking everything. Possibly farting all over the place....yick.

well, then you've already been informed. there is a difference between a display model and a demo model. demos are being test driven, while displays are only being touched and fiddled around with, not driven. They did not lie to you. Unless of course it was test driven (part of the 100km) and did not disclose that to you.

Problem was I wasn't told it was a display/autoshow vehicle, and i discovered the CA was aware of it before I signed the papers, but didnt tell me until i asked him almost one month after I took delivery of the vehicle.
I would not have taken the car if i was aware of the history of the vehicle. I only started investigating the origins of the car when: 1. I started having problems with the roof 2. Noticed it was a December '06 "production"

If it was a "display" car and honestly not a test-driven "demo" car, then its not that big of a deal. But cupholders in the rear console? Do e93s have a rear armrest? The cupholders on my car come out of the rear seat armrest.

E93 cup holders are integrated into the rear centre console because there is a removable piece for a pass through to compensate for the small trunk space.

They didn't lie to you about it being a display model.
Morally speaking, they should tell you, Legally speaking, no. Quote:

If it was a display car at an autoshow, it probably has a thick-ass showroom wax/coating...like a heavy make-up. I'd probably want the car un-prepped but what can you do.
Yes, the dealer should have told you beforehand but if not, I would ask for some kind of a compensation seeing all the problems you're having. |

I don't know the law on this topic, but I know what's right. They should have told you it was a display car at an auto show. Having been to many auto shows, I would not buy a display car unless it was discounted. I'd be pissed if I were you.

they don't sell preproduction vehicles, your car may be an early-production run, but not preproduction

I would get a lawyer, knowing what I know about show cars, I avoid them like the plague. I was offered a new Vette that was in a show and it stunk like a$$, cigs, you name it, the odor was unbearable.
Getting back, I would have not bought it, no matter what. |

It's more a matter of your dealer's integrity. Miles driven is really what makes a car a "demo". If you purchased a car on the lot that had been there for awhile it would also have had doubtless dozens of occupants and had the functions and features demonstrated many times. As long as they are taking care of fixing any problems you should be okay.

LEDZEP. I think you kinda hit the nail on the head, "doubtless dozens", not "thousands". Dozens I can deal with, thousands piss me off.
Not to metion the gearheads (no offense) who play with the open motor. Further, at the shows, there are a ton of cameras, purses, cell phones, in and around the car, who knows what people scratched inside, etc. There is absolutely no way I will be purchasing this car at the end of the lease.

and correct me if I'm wrong, but when I went to the autoshow, I'm almost positive that the E93 was not accessible to the public, it was on a display carousel

328 cab was behind a rope, not the 335. A few people have contacted me stating they were in and out of that car.
