BMW trys to make good on E92 Sport Supsension Calibration error!
Opened up the envelope from BMW NA and to my surprise......
For anyone who participated in this thread, http://www.e90post.com/forums/showth...ort+suspension I wonder if you got a letter too? Now, the question comes about that do I make a bigger stink about getting the standard suspension and request the correct suspension be installed or do I just take this $200 gift certificate and go on my merry way?

Well aint that something.. depending on how long it would take to get it done and whether or not I was going to go with a certain aftermarket brand.. I’d probably try to get them to change it. Although I doubt they would do it.

Yeah, I would contact them and explain the the sport suspension was one of the reasons you purchased the car you did. Therefor they've lied to you and not given you the vehicle that you ordered.
Wonder how the BBB would feel about them misleading their customers. You didn't buy the car to get $200 worth of crap like hats, polos and keychains.

Don't use the cash certificate, talk to your lawyer and get your sport suspension back from BMW at all costs.

OK, here's my dilema and after at least five minutes of agonizing over it, I think I'm inclined to do this:
On the previous thread, I posted this little ditty which is in every brochure every car manufacturer produces: #1: I love my car and have loved the road feel from the first day I drove it back from the performance center. If the tires were made from Dunkin Donuts Bavarian Creams and it had a suspension from a Hyundai Tiburon, it wouldn't change the fact that I just love how this car handles. #2: Let's say I pressed to have BMW replace the suspension and they agreed. For whatever reason, I then don't like the way car feels, or they screw something up while doing it...I have that kind of luck. I don't think they would switch it back for free. #3: As for speaking to a lawyer, I think BMW's disclaimer covers their butt, but I will inquire anyway. #4: $200 for hush money.....that's a little insulting..

Not sure if it's possible...
but what about taking them up on the $200, but asking that it be paid in a check to be used at your discretion. That way you can put it towards aftermarket suspension.

If you like the comfort, and it sounds like you do, take the $200. They could certainly put a suspension on there that you don't like in trying to fix it.

same thing happened with Infiniti for the LSD on the coupe.
apparently the cars with automatic w/o the sport suspension didnt receive the LSD on certain years. the first offereing was a $200 check. in the end they either bought the cars back or offered $1k or so. bottom line, dont accept the $200. please research the infiniti threads they will provide history of a car being sold under the expectations of the monroney label and failure to do so. gl ppp

There is no mention on the monroney label regarding sport calibrated suspension ...but I will investigate all options other than that $200 gift certificate.

That's my biggest concern. I did test drive a coupe but there is no way of knowing if that particular vehicle had the sport suspension or not.

Thinking about this and speaking with other people, I am now getting offended that they think I can be bought off with a $200 GC. I paid a premium for the coupe and now feel I did not get what I expected.
Anyone know how to garner a class action lawsuit?

Looks like you have a few paths to choose from
1) Let it be and enjoy life (sleeping dogs and all that) 2) Demand a refund for the full cost of the ZSP (since you didn't get what was advertised) 3) Demand that they install the ZSP suspension Have you called the 800 # listed on the letter? |

I say, make them give you the price difference from a ZSP suspension and a non-ZSP suspension. And have them give you that in a check.
Don't settle for the $200. GL Steve!

They would have to figure the additional cost of stiffer springs and shocks plus installation to make it like the standard sport calibrated suspension that comes on the coupes. Anyone have an idea what that would be?

BMW's behavior is in stark contrast to that of other companies that make such a mistake (and BMW seems to make a bunch of 'em). Some years ago, Honda proactively extended the warranty on my wife's AT, because the failure rate was above their acceptable minimum (we've not experienced difficulty with hers, but we're covered to 100 K if it craters). Similarly, when Mazda mistakenly advertised an inflated HP value for the '01 Miatas, the company offered to buy back the car, extend the warranty, or issue a cash refund ($1500 is my recollection, but it certainly was more than 200 bucks worth of T-shirts). I was planning to order a new E90 tomorrow (trading in my '03 325i - which, I must say, has been a very reliable car), but with all of BMW's recent fumbles with fuel pumps and oil coolers, iDrives that continue to crash, simple iPod interfaces that don't work, and now - a manufacturing system that can't get the springs and shocks right - I'm going to have to rethink my plans. Anyway - insist on a significant refund. |

From Steve's comments so far, I'm betting he would be bummed if he had them change the suspension. Don't get me wrong, I have and love the sport suspension. But it is harsher than the standard suspension. I could picture someone used to the standard suspension being bummed at their new "harsh" ride. (harsh only in comparison and only on less than smooth roads)
