As mentioned above mostly by the look of the tips and the sound of it.
Take a picture of the exhaust to compare the pipes and make sure they also match the pics provided by Dackelone

If you're looking at pics of cars you are interested in, the chrome / black is the easier way to see. You'll also learn soon to recognize the stereo levels, the shape of the seats to check for the M Sport package, spot the seat heater buttons, and so on

Is this true? They might discontinue the PE? What if we get in an accident or something happens where we need to get another one? SOL?

BMW recently changed their replacement parts programs to 7 years, if I remember reading that correctly. They also stop production of replacement parts after a model is discontinued. I read a post about it on bimmerpost a couple weeks ago. Don't know if that decision was ever made, or approved, but that was the speculated plan to save BMW millions of dollars per year. Given that BMW would even entertain this solution as an option, makes the 10 year law seem untrue.
