2015 X5 35 Totalled-Driver walks away

Hello folks,
Last Friday around 2pm, I left work and came to an intersection on the feeder road to the highway. An F-550 wrecker was coming opposite me, wanting to turn left in front of me. As I accelerated into the intersection, he turned in front of me and accelerated into my driver's door hinge, knocking my Bmw across the curb and 25 feet into the ditch. Side impact airbags, seat and head, went off. Seat belt tensioned up and broke. The wrecker driver had accelerated from a stop and impacted my Bmw when I was half-way through the intersection. Large intersection, large wrecker and lead-footed and in a hurry truck driver. State Farm looked at the pictures and satellite imagery of the accident, and determined that the wrecker driver was at fault. Bmw roadside assistance called for the cops, but a "Constable" showed up without enough backbone to call anyone "at fault." His reasoning was "He tells me a different story, and there aren't any witnesses." Never mind the skid marks laid down by the wrecker.
The F550 had damage to the bumper and tow hooks. My 2015 Bmw diesel X-5 with 40,000 miles on it, was totalled. Repair estimates exceeded $38,000 dollars. State Farm agreed to total it out. My selling dealer was asked if I could cancel and recover some of the $10,000 dollars that I had spent on the extended warranties (Maintenance, Tires & Wheels and Platinum Extended Protection), since none had been used since my Bmw had not yet hit 50,000 miles. He told me that I could recover pro-rata on the Maintenance and the Tire & Wheel, but not the $4,000 Platinum Extended Warranty. I found the actual Platinum Extended Warranty sign-up sheet and the warranty booklet, and found out that he was wrong. My State Farm agent advised me to tell the Total Loss rep to provide a one-page summary of the total-loss, or Bmw would kick the request back until I submitted just the one-page total loss paperwork. Wondered if any forum members had anything similar happen to them?
My main reason to post this item, is to say two things:
1. The Bmw X-5 took a nasty hit, yet I walked away with a sore back from the airbag impact. The X-5 was totalled, and I basically had a sore rib cage for a few days. I am happy with Bmw engineering!
2. If anyone knows where I can find a new, un-sold X-5 35d from 2015 or 2016, please let me know

Wow! Really glad you're ok!

There really aren't any 15 or 16s that are new, BUT you can order a 17 3.5d brand new. I just got mine 2 weeks ago.

Just reach out to a CA and get a quote, but make sure they have an available allocation for you.

glad you're ok.
after getting hit by a drunk last year on my 5k mile x5, i now put dash cams in all my vehicles. it's $100 well spent.

You will like the 2017, some nice iDrive enhancements (new version).

First and foremost, I am glad you are okay and walked away without any serious injuries. I agree with turboawd's comment, get yourself a good quality 2 channel dash cam. It is worth the investment! The most popular ones for the F15 are the Thinkware, Blacksys, or Blackvue brands. There are plenty of YouTube reviews out there as well as in here.

Glad to hear that you walked away from that kind of hit with no major injury. Looks like the X5 took that hit like a champ and protected the occupant in the cabin. Just goes to show how solid these cars are. Hope you find a replacement quickly!

Wow, glad to hear that you are ok.
I suggest you to get further check on your internals where you won't feel it until later.

Always glad to hear that there were no injuries in an accident.

To be honest, the photos don't look that bad considering you were "T-boned" by an F550! Maybe I'm looking at the car from the wrong angle or the pictures don't show the full extent of the damage but I'd be shocked if the driver didn't walk away.

Glad you were not injured.

I recommend a dash cam. Saved me twice already when the other driver said I appeared out of nowhere or cut them off.

Dash cam owners please recommend a good one that is small and unobtrusive and $150 or under. most of these look pretty big amd I dont want to be looking at it obscuring the front view

i've installed this in 3 vehicles. i like how they dont stand out much. and its rated good. get the hardwire kit with it. then you can run the wire over to passenger pillar and then down to fuse box behind glove compartment.

Dash cams have been used in South Korea and other Asian countries for the last 10+ years and it is very common there. I would say 90% of cars have these installed. Looks like USA is finally catching on lol. With that said, I haven't thought about installing one yet.

I didn't think much of it either Kzang. my buddy has them in all his cars and I thought he was a little paranoid. then when wife was side swiped a couple of months ago and the at fault driver lied to her insurance carrier placing the blame on my wife. I couldn't order fast enough.

Yup. Last year driver hit my rear quarter panel after running a stop sign. Police came and she told them I cut her off with this sad look. Maybe she faked some tears. I guess she gave the sob story to her insurance since they put me at fault.

Fortunately I had my dashcam footage showing her running the stop sign, not looking left (to see I was already past her), and her running into me. So my insurance put her at blame. Then eventually they went into arbitration to get my deductible, but it was an easy win for us because of the footage.

@alphaod, glad that worked out to your favor. I can't believe your claim still went to arbitration! Police are so busy they don't even respond anymore. They just tell you to exchange info and file a report on line. They only investigate if there is an injury.

Nahhhh, not necessarily true. For instance in Philly cops will never even come for the accidents, may be with some serious injury, but in contrast, in burbs, cops are very happy to "investigate" every little fender bender. )))))
